The Argentine Supreme Court decriminalized,
Tuesday, August 25, possession of small quantities
of marijuana for personal use.
The court ruled unconstitutional penalties
to adult consumers, when they do not endanger others.
Under the Basic Law, "private actions of men who
violate any order and morals, nor affect third,
do not fall under the authority of magistrates,
" the court said in a statement sent to reporters.
The Court was asked to comment on the sentencing
of five youths arrested by police early 2006,
when each of them had between one and
three joints of marijuana in his pockets.
The announcement came four days after Mexico
had announced a broader decriminalization
of drug use.
Under a new law, the Mexican justice system
no longer pursue consumers with less than
5 grams of marijuana, half a gram of cocaine,
two grams of opium, or 50 milligrams of heroin.
They will, however, undergo medical treatment.

Selon la Loi fondamentale, "les actions privées
des hommes qui ne portent nullement
préjudice à l'ordre et à la morale publiques,
ni ne nuisent à un tiers, ne tombent pas
sous l'autorité des magistrats",
a déclaré la Cour dans
un communiqué transmis à la presse.
La Cour était appelée à se prononcer sur
la condamnation de cinq jeunes arrêtés
par la police début 2006, alors que
chacun d'eux n'avait qu'entre un
et trois joints de marijuana dans ses poches.
Cette annonce intervient quatre jours après
que le Mexique eut annoncé une dépénalisation
plus large de l'usage des drogues.
En vertu d'une nouvelle loi, la justice mexicaine
ne poursuivra plus les consommateurs
détenant moins de 5 grammes de marijuana,
un demi-gramme de cocaïne,
deux grammes d'opium ou
50 milligrammes d'héroïne.
Ils devront toutefois se soumettre
à un traitement médical.
